Privacy Policy
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, the “GDPR”) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”), Mutualidad hereby provides information on the data processing carried out through the #MutuaTech platform (hereinafter, the “Platform”).
This policy applies to the user who is registered as a user of the Platform (hereinafter, the “User”) and refers to the processing of the data that will be collected and managed through the Platform in an integrated manner with Mutualidad’s systems.
DATA CONTROLLER
The data controller is the entity that has contracted the services provided through the Platform in order to use the services offered.

PURPOSE AND LAWFUL BASIS OF THE PROCESSING
The purposes and legal bases on which Mutualidad will process the personal data of the User of the Platform are as follows:

To manage your registration and identification as a user of the Platform: If you decide to register as a user on our Platform, we need to process your data in order to identify you as a user and give you access to the different functionalities and services available to you as a registered user.
Legal basis: the processing of data for your registration on the Mutualidad Platform is necessary for the performance of a contract (Article 6.1(b) GDPR), understood as the terms governing the use of the Platform. -
Commercial communications: Mutualidad will process your data to send you the Mutualidad newsletter and its own commercial communications informing you about our products and services, as well as other events and activities related to Mutualidad.
Legal basis: The processing is based on your consent (Article 6.1(a) GDPR). -
Events: Mutualidad will process your personal data for the purpose of managing registration for the events offered on the Platform, as well as confirming that the requirements for registration and participation in the event are met and keeping you informed about updates related to the event.

Profiling: Mutualidad will process your personal data for the purpose of carrying out profiling in order to personalise the commercial communications offered to you, without this having any other effect on the relationship with you.

Management of queries, complaints or claims: if you contact us to raise a query, complaint or claim related to the Platform, your personal data will be processed in order to manage the query, complaint or claim.
Legal basis: the processing of personal data will be carried out on the basis of the User’s consent when sending the communication. -
Compliance with legal obligations: the processing of the User’s personal data may be carried out in compliance with legal obligations imposed on Mutualidad, such as, for example, communications to competent authorities in the event of inspections or administrative proceedings requiring information about the User.
Legal basis: the processing of personal data will be carried out on the basis of a legal obligation imposed on Mutualidad.
SOURCE OF PERSONAL DATA
The data may be collected directly from the User when using the functionalities of the Platform or through the data that Mutualidad has associated with the User due to the contractual relationship that may exist between them.
RETENTION OF PERSONAL DATA
Your personal data will be processed for the period necessary to fulfil the purposes described in this Privacy Policy and for the time necessary to comply with the obligations imposed by applicable laws, especially considering statutory limitation periods, and taking into account the bringing, exercise or defence of claims.
RECIPIENTS OF PERSONAL DATA
Depending on the purposes for which the personal information is collected, the following persons/entities may have access to such information, as applicable:

Authorised personnel of Mutualidad or its representatives acting on behalf of Mutualidad, subject to the applicable data protection laws;

Public administrations, regulatory authorities or other third parties in accordance with applicable laws;

Third parties (service providers that process information as data processors, under Mutualidad’s instructions). All this only after taking the necessary measures to ensure that we can share such information in compliance with the applicable data protection laws.
DATA PROTECTION RIGHTS
You have the right to:

Right to request access to personal data: you may check whether Mutualidad processes your personal data and, if so, access it.

Right to request rectification if the data is inaccurate, or to complete data that is incomplete.

Right to request erasure of your data.

Right to request restriction of processing: in this case, your personal data will only be retained for the bringing or defence of claims.

Right to object to processing: Mutualidad will stop processing your personal data, except where it must continue to be processed for legitimate reasons or for the bringing or defence of possible claims.

Right to data portability: if you want your data to be processed by another data controller, Mutualidad will facilitate, whenever technically possible, the transfer of your information to the new controller.

Right not to be subject to a decision based solely on automated processing of your personal data. If you have given consent for any specific purpose, you may withdraw it whenever you wish, without this affecting the lawfulness of the processing based on consent prior to its withdrawal.

ADDITIONAL INFORMATION
- International transfers: Mutualidad, through its providers, carries out transfers of personal data outside the European Economic Area (EEA). Such transfers are carried out in compliance with applicable data protection laws. In particular, the providers with whom Mutualidad works comply with one of the following requirements: i) the data processing is carried out in a territory that guarantees an adequate level of protection according to the European Commission; ii) the provider has adopted binding corporate rules; or iii) a standard contractual clauses agreement has been entered into with the provider. Regardless of where your personal data is collected or processed, Mutualidad ensures and guarantees that service providers maintain appropriate technical and organisational security measures to protect information about you.
- Policy on children’s use. The Platform is intended exclusively for adults. In this regard, and consequently, Mutualidad does not knowingly collect information from minors. In any event, if you are a parent or legal representative and consider that your child or ward has sent us personal data, please contact us by writing to proteccion.datos@mutualidad.com.
- Updates. The processing of Users’ personal data will be carried out in accordance with the Privacy Policy in force at the time the User’s personal data is collected. If Mutualidad makes any change to the processing of the data, you will be duly informed accordingly.
